   I covered the Kaua`i ADA lawsuit extensively at the time in a series of PNN articles and here’s the skinny.

   Dick Miller, who was hearing impaired, sued the county to provide captioning for meetings already being cablecast but there was never a “judgment”, only a “consent decree” signed by Dick and the County to close-caption meetings (actually they are so incompetent that can’t do closed captioning reliably so they do open captioning). However the decree was just between the county and Dick, not the hearing impaired community as a whole so as soon as Dick died the consent decree was null and void. They still however caption the meetings.

   While DCAB did “advise” them to caption, DCAB has no regulatory function and is advisory in nature and when asked they always advise for the maximum service to the disabled community.

   I’m not sure of HI county’s set up but it can’t be any more than literally flipping a switch to live stream, especially if they are already posting them on line on demand. There may be a very minimal set up cost- the cost of some connectors- but it’s just a matter of making a connection from the site where the meetings are being “recorded” to the head end of the cable access system.

   The county contracts with a firm in O`ahu and they caption it live, fairly cheaply (it was about $125 an hour hears ago I’m not sure how much it is now). It’s done over phone lines.

   The most galling thing on Kaua`i is that the administration’s IT head, Eric Knudzen is now posting planning and police commission meetings and planning live streaming soon. But the council, which is set up as an agency that is independent of the administration, won’t allow Knudzen to set-up their live streaming or even posting under his auspices.
